From the state that begrudgingly banned shooting suspected illegal immigrants from helicopters comes this new bit of insanity. Texas state Rep. Steve Toth (R-lunatic) introduced legislation that would make any federal law banning certain semiautomatic firearms or limiting the size of magazines unenforceable in Texas. “This is a hardened state. This isn’t a good place for a criminal to show up and start shooting. We want to make sure this legislation protects the Second Amendment gun rights and the Tenth Amendment which is state sovereignty rights of Texans.”
For people who claim to revere the US Constitution so much, it seems like these TEApublican buffoons don’t know the first thing about it. The Supremacy Clause of the U.S. Constitution states that Federal Law trumps state law.
Fox “News” host Peter Johnson Jr. pressed Rep. Toth to explain. Get ready for some weapons-grade bull:
“We target a very specific portion of where the Obama administration’s proposed legislation is infringing on our Second Amendment rights, and it only deals with those two things. For example, the size of a magazine and the type of weapon. We’re very specific about it, and we’re not going after federal officials. We’re simply saying state officials within the state of Texas are are not allowed to violate our Second Amendment as it pertains to these two things. The way you eat an elephant is one bite at a time, and we’re going to start first with state officials that are also dual — a state official that acts both as a federal and state official,” said Toth. “These are people that are county sheriffs and so on.”
Johnson asked for clarification “Law enforcement officials in the state of Texas could be charged with a crime themselves if they enforced those federal provisions?”
“Correct,” Toth agreed.
Under the Firearm Protection Act, anyone trying to enforce a federal gun ban could be charged with a felony.
