This Monday, Raphael Cruz warned that tyranny is just around the corner in the form of the “death panels” — which Sarah Palin has been telling us about since Obamacare was first signed into law in March of 2010.
The father of TEA party darling Senator Ted Cruz (R-TX) made his comments at a Tea Party event in Fairfield, Texas.
“You know those death panels that Sarah Palin talked about?” he asked. “Finally this administration admitted those death panels do exist. You know, in fact, they’re called IPABs.”
“But let me tell you something most people do not know: By February of 2017, IPAB will be totally independent of government,” he continued. “No oversight whatsoever. Not under the control of the President or of Congress. It will become another tyrannical dictatorship with no control by anyone, and that will occur — according to Obamacare — it has a date set February of 2017. You better have gotten rid of Obamacare by then, because otherwise it’s total control.”
Of course the actual facts do not back his allegations in any way. The IPAB, or Independent Payment Advisory Board, is a 15-member independent government agency which is mandated to find and recommend measures that can be taken to reduce the costs associated with Medicare. That is its sole responsibility; it can recommend but it cannot impose the changes. That power remains in the hands of Congress.
PolitiFact looked into this particular provision of the law during the 2012 Presidential campaign when Mitt Romney made similar allegations and found his statements, which were much less harsh than Cruz’s claims, to be mostly false.
The claim was debunked in 2011 by a paper from the nonprofit, nonpartisan Kaiser Family Foundation which found that the IPAB would only have the power to recommend ways in which increases in health care costs might be curtailed, but that it is forbidden from making any recommendation which includes any form of rationing, according to Section 3403 of the health care law.
It is too bad that Raphael did not specify who it was in the administration who “admitted” to the “death panels” or exactly what it was that they said as a thorough search of the internet provided no example of this ever having happened, only numerous claims on far right pages which took words out of context or completely misstated what was said.
