Phillip Andrew Engle, 27 of Muskegon Township, Michigan was reportedly high on LSD and clad only in a towel when he beat on the window of Happy’s Pizza near his home on July 26 — while holding his .40 caliber handgun — shattering the window and accidentally discharging the weapon into the casing of the store’s door. At the time he was accompanied by his three children, aged 6, 4 and 3.
Engle was arraigned on four misdemeanor charges of malicious destruction of property that’s valued over $200, but less than $1,000; careless discharge of a firearm causing property damage; reckless use of a firearm; and possession of a firearm while under the influence on Monday, July 28 in Muskegon County 60th District Court. He was released on a $10,000 bond and will return for a pretrial hearing on August 27.
Police reported that he is facing two weapons charges because he also accidentally discharged the weapon inside his car although it is unclear if that was related to the incident at the pizza parlor.
Engle admitted to police that he had taken four hits of acid earlier in the day before loading the kids into the car and heading to Happy’s Pizza where he wanted to eat. When he arrived he began to beat on the window because he thought that the store was closed, although it was open and two employees were clearly visible inside at the time.
He left before police arrived but they were able to track him to his home where they found him sitting on the porch with his gun still in hand.
Child Protective Services is investigating the incident because the children were present when the gunfire was taking place.
