A “responsible gun owner” in California could be facing charges for unleashing a spray of freedom bullets into the back of an unarmed, pregnant home intruder as she was fleeing, despite that she told him she was with child.
80-year-old Tom Greer returned home to find a man and a woman robbing his house. “I walked in on them,” Greer told KNBC. “And they jumped on me in the hallway.” He claims he was tackled and thrown to the ground, but managed to grab his trusty .22-caliber revolver and confront them as they attempted to pillage his safe.
When the duo saw Greer’s gun, they ran out of the house and down an alley. “I come back and they see me with a gun, and they run,” he said.
“The lady, she couldn’t run as fast as the man, so I shot her in the back twice,” Greer explained. “She’s dead, but he got away.” He added, “She says, ‘Don’t shoot me, I’m pregnant! I’m going to have a baby!’ And I shot her anyway.”
When asked what he saw happen to the woman after he fired at her, Greer responded, “She was dead. I shot her twice, she best be dead … (The man) had run off and left her.”
Greer explained his reasoning for shooting the woman, whom he knew was pregnant, and said he has no regrets about doing it. “I shot her so that’s going to leave a message on his mind for the rest of his life,” he said.
It is unclear if he will be facing charges, but Long Beach police said they are investigating. However, charges are a possibility.
“Investigators have to look at both sides of this coin,” said legal analyst Royal Oakes. “On the one hand a frail man in his 80s is being attacked in his own home by intruders, he has a right to self-defense. On the other hand, he did shoot a person who was trying to get away, so he wasn’t in imminent danger himself and the law says you can’t shoot somebody under those circumstances.”
